Terms of Service

These terms describe the rules, limits, and risk allocation for using Roamly to plan shared trips, save places, earn and spend credits, and generate itinerary ideas.

1. Accepting these terms and eligibility

By accessing or using Roamly, you agree to these terms. If you do not agree, you must not use the service. You represent that you have the legal capacity to enter into a binding agreement and that your use of Roamly complies with applicable law.

2. Limited license

Subject to these terms, Roamly grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the app and related services for your personal, non-commercial travel planning use. Roamly and its licensors reserve all rights not expressly granted.

  • You may not copy, resell, rent, lease, sublicense, or commercially exploit the service except as expressly permitted by Roamly.
  • You may not reverse engineer, decompile, disassemble, scrape, or attempt to extract source code or underlying models except where applicable law expressly permits it.
  • You may not use automated means to access the service in a way that burdens, disrupts, or bypasses normal product controls.

3. Nature of the Roamly service

Roamly is a travel-planning software service. Roamly is not a travel agency, tour operator, carrier, accommodation provider, restaurant operator, insurer, emergency service, or provider of legal, medical, tax, financial, or safety advice. Roamly does not provide, sell, broker, or manage travel bookings, reservations, flights, hotels, tours, travel packages, or travel club memberships.

Roamly does not guarantee the availability, quality, legality, safety, pricing, timing, suitability, or accuracy of any destination, activity, route, booking, place listing, or third-party offer.

  • You are solely responsible for verifying reservations, prices, opening hours, weather, local conditions, transport schedules, visa and border requirements, accessibility, health and safety issues, and the suitability of any itinerary or destination for your circumstances.
  • Roamly must not be used as an emergency, navigation-safety, or mission-critical system, and no suggestion or map output should be treated as a substitute for real-time judgment or official guidance.

4. Accounts and account security

You are responsible for the accuracy of the information you provide, for activity under your account, and for maintaining the confidentiality of your login credentials and linked devices. You must promptly notify Roamly if you suspect unauthorized access, device compromise, token misuse, or any other account security issue.

5. Your content and permissions

You remain responsible for the destinations, notes, messages, preferences, images, and other content you submit to Roamly. You represent that you have the rights needed to submit that content and that it does not violate law or third-party rights. You grant Roamly a worldwide, non-exclusive, royalty-free license to host, copy, process, adapt, transmit, and display that content only as needed to operate, secure, maintain, improve, and support the service.

  • Roamly may remove, restrict, or refuse content that it reasonably believes is unlawful, infringing, abusive, unsafe, fraudulent, or harmful to the service or its users.
  • You remain solely responsible for backups of your own content and for the consequences of sharing trip data with a partner or other person.

6. AI outputs, maps, and place data

AI-generated itineraries, route suggestions, place summaries, budgets, categories, timing estimates, and other automated outputs are drafts generated from probabilistic systems and third-party data sources. They may be incomplete, inaccurate, offensive, outdated, biased, unavailable, duplicated, or unsuitable for your trip.

  • You are solely responsible for reviewing, editing, and validating AI output before relying on it.
  • Roamly does not guarantee that any AI output, place result, route, recommendation, translation, notification, or optimization will be correct, useful, or fit for a particular purpose.

7. Credits, payments, and rewarded ads

Roamly may use credits, paid top-ups, promotions, and rewarded ads to unlock or limit certain software features. Credits are a limited, non-transferable contractual usage right within Roamly only. They are used only to access Roamly app functionality, such as AI itinerary generation, AI travel planning assistance, and destination/place discovery searches.

Credits are not money, do not earn interest, do not represent stored value, are not bank deposits, have no cash value, and cannot be redeemed, withdrawn, exchanged, transferred, gifted, resold, or used outside Roamly, except where mandatory law requires otherwise.

Roamly does not provide, sell, broker, or manage travel bookings, reservations, flights, hotels, tours, travel packages, or travel club memberships through credits or paid top-ups.

  • Credit balances, feature costs, ad rewards, top-up options, and promotional mechanics may change at any time.
  • Paid credits may be added, withheld, adjusted, reversed, or removed if a payment fails, is reversed, is refunded, is disputed, is fraudulent, or if Roamly reasonably suspects abuse, manipulation, automation, duplicate claims, or violation of these terms.
  • Rewarded ad credit is granted only when completion is successfully confirmed by Roamly or its advertising partners. Roamly may deny or reverse rewards for fraud, duplicate claims, technical abuse, failed verification, or incomplete ad views.
  • Unless otherwise required by applicable law, platform rules, Paddle’s applicable buyer/refund terms, or Roamly’s express written policy, purchases, top-ups, and used credits are non-refundable and non-transferable.

8. Acceptable use

You may not misuse Roamly or help others do so. This includes attempting unauthorized access, interfering with the service, bypassing billing or credit controls, harvesting data, impersonation, submitting malicious content, infringing rights, or using the service for unlawful, harmful, deceptive, harassing, or abusive conduct.

9. Third-party services and app stores

Roamly may rely on third-party providers for maps, places, AI generation, analytics, billing, cloud hosting, communications, ads, authentication, and media. Those services may change, fail, suspend access, or apply additional rules outside Roamly's control. Roamly is not responsible for third-party services, content, policies, transactions, or failures.

  • If you downloaded the app through Apple App Store, Google Play, or another platform, that platform is not a party to these terms and, to the maximum extent permitted by law, is not responsible for the app, support, maintenance, or claims relating to it.
  • Use of third-party services may also be governed by separate terms and privacy policies from those providers.

10. Suspension, termination, and investigations

Roamly may investigate conduct that may violate these terms or harm the service, users, partners, or third parties. Roamly may, with or without notice and to the maximum extent permitted by law, suspend, limit, terminate, delete, or refuse access to any account, feature, content, credit balance, reward, or integration if it reasonably believes that doing so is necessary for security, legal compliance, fraud prevention, abuse prevention, or service integrity.

11. Availability, changes, and beta features

Roamly may update, suspend, discontinue, or change any feature, plan, model, price, route, integration, notification, or part of the service at any time. Some features may be experimental, beta, limited, region-specific, or unavailable on some devices or accounts. Roamly has no obligation to continue any feature or maintain backward compatibility.

12. Intellectual property

Roamly, its branding, software, interface, content formatting, design elements, documentation, and service-related materials are protected by intellectual property and other laws. Except for your limited rights under these terms, no rights are granted to you by implication, estoppel, or otherwise.

13. Disclaimers

To the maximum extent permitted by applicable law, Roamly is provided on an as is, as available, and with all faults basis, without warranties or conditions of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, security, accuracy, quiet enjoyment, or satisfactory quality.

  • Roamly does not warrant that the service will be uninterrupted, error-free, secure, always available, or free from harmful components.
  • Roamly does not warrant that defects will be corrected or that any result from using the service will meet your expectations.

14. Limitation of liability

To the maximum extent permitted by applicable law, Roamly and its affiliates, owners, officers, employees, contractors, licensors, service providers, and partners will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, bookings, travel opportunities, reputation, or business interruption, arising out of or related to the service, even if advised of the possibility of such damages.

To the maximum extent permitted by applicable law, Roamly's aggregate liability for all claims arising out of or relating to the service or these terms will not exceed the greater of (a) the amount you paid to Roamly for the service in the 12 months before the event giving rise to the claim, or (b) USD 100.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including mandatory consumer rights and, where applicable, liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

15. Indemnification

To the maximum extent permitted by applicable law, you will defend, indemnify, and hold harmless Roamly and its affiliates, owners, officers, employees, contractors, licensors, and partners from and against claims, demands, actions, losses, liabilities, damages, judgments, settlements, penalties, fines, costs, and expenses, including reasonable legal fees, arising out of or related to your content, your trip data, your misuse of the service, your breach of these terms, your violation of law, or your violation of any third-party right.

16. Consumer rights, severability, and waiver

If you are a consumer, nothing in these terms is intended to limit or waive rights that cannot be waived under applicable law. If any provision of these terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Roamly's failure to enforce a provision is not a waiver of its right to do so later.

17. Changes to these terms

Roamly may update these terms from time to time. The updated version becomes effective when posted, unless a later date is stated. Your continued use of the service after the effective date means you accept the revised terms.
